We live blogged as the court released opinions in two cases from the current term.

  • The court ruled 7-2 in Rudisill v. McDonough that servicemembers who, through separate periods of service, accrue benefits under both the Post-9/11 Veterans Act and the Montgomery GI Bill, can use either one, in any order, up to a 48-month aggregate cap.
  • The court holds in DeVillier v. Texas that property owners whose land was flooded by the state’s actions to prevent flooding on a Houston highway can pursue their claims under the Constitution’s takings clause through a cause of action under Texas law. DeVillier had argued that he could pursue his action under the takings clause itself, but the Court holds that Texas law provides a cause of action.
