At around 9 P.M. on May 13, police officers were called out to a residential area in Las Vegas. Over the phone, authorities were told that a crash had occurred with a pedestrian. When the authorities arrived at Forsythe Drive and Skywood Way, they discovered a 15-year-old boy in very bad shape. The boy was immediately rushed to Sunrise Hospital, where he was issued in critical condition.
At the scene, they learned that the teenager was harmed after getting run over by a Jeep Wrangler driven by 19-year-old Destiny Jimenez. Jimenez was allegedly driving the Jeep while the victim was holding onto the passenger side and attempting to navigate on a skateboard. Jimenez was also reportedly under the influence.
As Jimenez and the 15-year-old attempted to perform the reckless stunt, the teenager reportedly lost balance and fell off the skateboard. Jimenez was not able to stop in time and ran over the youngster.
Due to the suspect’s level of intoxication, she was arrested at the scene. Jimenez is facing multiple charges including DUI resulting in substantial bodily harm, reckless driving resulting in substantial bodily harm, and driving without a driver’s license. Jimenez was booked into the Clark County Detention Center where she’s being held without bail.
Who is Liable in These Situations?
Sadly, the 15-year-old juvenile has not yet been discharged from the hospital as of four days after the accident occurred. As you can imagine, his family is struggling to make sense of what happened. Amidst the tragedy, they’re also likely paying a significant amount of money on medical bills.
Since the suspect is 19 years old and she was intoxicated when the accident occurred, it’s highly likely that she would get held financially liable for the fallout from this accident if the injured teenager’s family decided to seek out a lawsuit.
While the suspect has been arrested, criminal charges will not address the family’s financial losses. In order to get that type of compensation, the family would need to pursue a personal injury lawsuit in civil court.
Personal injury lawsuits help individuals who get hurt by another person’s negligence. The aim of these lawsuits is to provide the injured party with financial compensation for their losses. If you’ve recently been in a similar type of accident, then it might be in your best interests to determine whether you should seek out a claim, too.
