Maui Wildfire Deaths: Were They Preventable?

By now, almost the whole nation has heard about the devastating wildfires that annihilated Maui, Hawaii. Unfortunately, an out of control fire spread directly into areas with large populations and in a city that’s between a volcano and the ocean. Due to the position of the fire, escape routes were very limited.

This confined space caused the Maui fire to rank as one of the deadliest U.S. wildfires in the past 100 years.

Right now, investigations into what happened are still ongoing. Unfortunately, very concerning details are emerging. Officials insist that they took all the necessary precautions they could to avoid the tragedy. They also say that the fires were largely uncontrollable as a result of wild 80 mph winds. Hawaii’s Governor, Josh Green, stated that his administration has “doubts that much could have been done with a fiery, fast-moving fire like that.”

This narrative isn’t sitting well with Hawaii residents or citizens abroad. According to many, there is plenty of evidence that more could have been done to protect Hawaii’s residents. In fact, most residents are saying that there was time to send an alert to residents. If an alert had been issued in time, then countless residents would have escaped.

Interviews with Maui County officials reveal that little was done to prepare for a situation like this despite mounting evidence that a preparation plan should’ve been put in place. Back in 2018, another monumental fire hit West Maui and spread via fast moving winds just like this recent fire. This incident should’ve prompted officials to make a plan for a future fire.

Even back in 2021, a Maui County government commission wrote about how island communities are particularly vulnerable to fires because populations are clustered and escape routes are limited. They even explained how Maui’s fire problem is more extreme than in the mainland due to these factors.

As the fire blazed on, there were very few updates from Maui’s responders until the fire was considered 100% contained. Even worse, multiple fires were occurring in different areas, no alarm was sounded, and no evacuations were ordered.

Will There Be Legal Recourse for Maui Wildfire Victims?

Could lives have been saved if safety officials had put a plan in place? That’s an answer that the courts will have to sort out. It might be possible for Maui wildfire victims to seek out legal recourse through a personal injury claim against the government officials in charge of overseeing safety procedures in Maui.

Throughout this claim, courts will need to determine whether government officials were negligent. Clearly, the government and Maui’s safety team have a legal duty to provide for the safety and care of Maui residents. So, it will be up to court officials to determine whether government officials did their due diligence in warning citizens or if they failed to uphold their duty of care.
