Last year, Tyler Kennedy, a 33-year-old self-proclaimed career criminal, was reportedly driving over 90 mph when he slammed into a Ford F-150 that was carrying a family from Idaho. The horrific incident resulted in the death of three individuals inside of the Ford F-150.

According to Kennedy, the horrific DUI isn’t entirely his fault, although he has pled guilty. Why? Authorities had stopped the suspect hours earlier and allowed him to drive away despite admitting to taking opioids to avoid withdrawal. During this initial traffic stop, police reportedly discovered drug paraphernalia, pills, and tin foil in the car. Police also suspected the driver was high on fentanyl and not opioids.

Kennedy says that the authorities should not have let him go because he was clearly acting irrationally and was high on drugs. After the fatal crash, deputies again found a new bottle of pills, tin foil, glass pipes, and meth.

As a result of the crash, three family members perished and only two children survived. Both surviving children now suffer from significant brain damage that will prevent them from getting involved in contact sports for the duration of their life.

Now, the Nye County Sheriff’s Office is facing a lawsuit for allowing the suspect to drive away.

Is it Worth it to Seek Out a Wrongful Death Claim?

Have you recently experienced a similar loss? No one is prepared for the loss of a loved one, but it stings just a bit more when the loss is totally unexpected and at the hands of someone else. While that other party may have suffered criminal repercussions for their actions, those consequences won’t do anything to help you bear the emotional and financial losses you’ll endure. What can help you do those things is seeking out a wrongful death lawsuit.

Wrongful death lawsuits can help you recover losses that you suffered as a result of the passing of your loved one. Depending on your situation, that might include damages like:

  • Burial expenses
  • Medical expenses prior to the passing of your loved one
  • Property damage
  • Pain and suffering prior to the passing
  • Loss of spousal support
  • Loss of companionship

In most cases, it is worth it to seek out a wrongful death claim when you’ve suffered losses as a result of your loved one’s passing. The other person’s negligence means that they should be held civilly liable for your losses.
